Protection of Personal Information
1. Overview
Under the Act respecting the protection of personal information in the private sector, personal information is any information that identifies a natural person. Confidential information is therefore understood to mean any sensitive information or personal information whose access and use is restricted to persons or entities designated for this purpose, and whose dissemination would cause harm to the entity and its partners or to individuals. Molotov acknowledges that it will have access to personal, confidential, strategic, commercial, technical or legal information related to customers, employees, organizations, companies, partners, suppliers (hereinafter referred to as stakeholders), in particular, regarding their strategies, business opportunities, intellectual property, outsourcing agreements and other information of this nature. Molotov is therefore committed to protecting the confidentiality and security of its stakeholders’ personal information. This Privacy Policy is intended to help you understand Molotov’s practices regarding the collection, use and retention of personal information.
2. Applicable legislation
Molotov is subject to the personal information protection provisions of the Act respecting the protection of personal information in the private sector (RLRQ, c. P-39.1) when such information is held in the course of its functions and activities.
3. Information collection
Personal information is collected in a number of ways, including business model forms, database transfers, in-person communication, telephone, mail or e-mail. Molotov only collects personal information that is necessary for the conduct of its business and for the fulfillment of identified purposes.
Depending on the circumstances, personal information may include company and organization identifiers, worker identifiers, payment management information, strategic or contractual information about an entity, etc.
4. Use of information
Measures have been put in place to ensure that only authorized persons have access to personal information and are authorized to process data. A confidentiality agreement must be signed by all Molotov employees, agents and/or subcontractors with access to computer systems and confidential data. Furthermore, no data will be transferred to a third party without the written approval of the stakeholder.
Molotov recognizes that confidential information remains the exclusive property of the parties involved and that any unauthorized disclosure of such confidential information may cause significant damage to Molotov. In order to protect the interests of stakeholders, Molotov will use disclosed confidential information only for the purposes for which it was disclosed. All stakeholder data remains confidential, unless it has been published in the media or by the stakeholders.
A document is deemed non-confidential:
- If it contains no personal information and has no strategic value for the entity;
- If at the time of its disclosure, was in the public domain;
- If it becomes available, after the transfer of information between the stakeholders and Molotov, generally to the public, by publication or otherwise, and this disclosure is not the result of a fault committed by Molotov;
- If it is disclosed to Molotov by a third party;
- If it is government information.
The information collected is used for the following purposes :
- Register confidential data in the database;
- Process data;
- Save changes made in the database;
- Communicate with our customers;
- Develop our market relations;
- Manage our human resources;
- Offer a specialized communications service.
5. Information retantion
Molotov retains stakeholders’ personal information for as long as necessary to provide its services, or as required by applicable laws, regulations or government orders. Personal information may be retained for different periods depending on the nature of the information and the purpose for which it is held. By using Molotov’s services, stakeholders give their consent to the transfer of personal information to its database. Molotov never sells personal information to third parties, and written authorization is required before transferring confidential information from a stakeholder to a third party.
Molotov has put in place appropriate physical, technological or administrative safeguards to protect the confidentiality and security of personal information against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access, misuse or other unlawful form of processing of personal information in its possession.
However, no method of Internet transmission or electronic storage is 100% secure. If you have reason to believe that the confidentiality of personal and/or confidential information has been compromised, please contact us.
Molotov undertakes to take the necessary steps without delay to limit any damage that may result from a breach of privacy, to investigate any vulnerability and to take the necessary corrective measures to avoid any recurrence of such an incident.
6. Updates
The contents of this policy are subject to change without notice to reflect changes in our practices, technologies, legal requirements and other factors. Changes to this policy will be effective immediately. We encourage our stakeholders to stay informed about how Molotov handles personal information.
